Business Records Exception / Medical Evidence and Hearsay Exceptions Under the FRE

Medical records will business records for the purpose of the hearsay rule. Medical record-keeping processes must fulfill the legal system of the business records exception if a medicine album is to be permitted in court. This exception to the hearsay rege requires that the record meet four basic tests: 1. The record was made in the usual course of and business. 2. Aforementioned entry in the record was made by an employee or representative of that business who had personal knowledge of the act, event, or condition that is being recorded in the record. 3. The record was made on or near the time that the recorded act, event, instead condition occurred or reasonably soon thereafter. 4. One records were sustained in a consistent manner, after to a set procedure.
